1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Skyline DevHub ("Company," "we," "our," or "us") governing your access to and use of our website skylinedevhub.com and all related services, products, and platforms.

By accessing or using our services, you acknowledge that you are at least 18 years of age, are legally capable of entering into binding contracts, and agree to comply with these Terms. These Terms are binding upon you from the moment you access or use any of our services.

2. Definitions

• Services — All products, platforms, and services offered by Skyline DevHub, including consulting, development, and API access
• User Account — A registered account providing personalized access to our services
• Content — All materials uploaded, downloaded, or otherwise accessed through our services
• Enterprise Client — A business entity with a separate enterprise agreement
• Intellectual Property — Patents, trademarks, copyrights, trade secrets, and other proprietary rights

3. Eligibility and Account Registration

To use our services, you must:

• Be at least 18 years of age
• Be responsible for all activities under your account
• Maintain the security of your password and credentials
• Notify us immediately of any unauthorized use
• Provide accurate and complete information
• Not share your credentials with others

4. Acceptable Use Policy

You agree not to engage in any of the following prohibited activities:

• Using services to compete or develop similar products
• Violating applicable laws or regulations
• Uploading malicious code or viruses
• Attempting unauthorized system access
• Disrupting or interfering with service operations
• Harvesting user information without consent
• Impersonating any person or entity
• Automated data collection without authorization
• Bypassing security measures
• Using services for fraudulent or deceptive purposes
• Reverse engineering or decompiling any part of the services

5. Intellectual Property Rights

The Company owns all content, features, and functionality of our services. You are granted a limited, non-exclusive, non-transferable license to use our services for their intended purpose. No resale or creation of derivative works is permitted.

You retain ownership of content you submit but grant us a license to use it in connection with providing our services. All Skyline DevHub trademarks are protected and may not be used without written consent.

6. Payment Terms and Billing

• Fees are non-refundable except where required by law
• Enterprise pricing is available via custom agreements
• Monthly/recurring billing requires valid payment authorization
• You are responsible for maintaining accurate billing information
• Late payments incur interest at 1.5% monthly (or legal maximum)
• Prices are exclusive of VAT, GST, and sales taxes (your responsibility)

7. Service Availability and Support

We target 99.9% service uptime but do not guarantee uninterrupted availability. Scheduled maintenance may temporarily affect service access, with advance notice when possible.

Support tiers vary by service plan. Enterprise clients receive dedicated support channels. Standard support is available via email during business hours (CET).

8. Warranties and Disclaimers

We provide a limited warranty that services will perform substantially in accordance with documentation for 90 days from initial access. Beyond this, services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We make no warranties regarding results, accuracy, non-infringement, or uninterrupted service.

9. Limitation of Liability

Our total liability is capped at the amount you paid us in the preceding 12 months. We are not liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the legal theory (contract, tort, negligence, or strict liability). Jurisdiction-dependent exceptions may apply for certain warranties.

10. Indemnification

You agree to indemnify the Company against claims arising from breach of these Terms, violation of applicable laws, unauthorized service use, content you submit, or infringement of third-party rights.

11. Data Protection and Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Enterprise clients may request a separate GDPR-compliant Data Processing Agreement.

12. Termination

You may terminate your account at any time via account closure or by contacting us. We may immediately suspend or terminate your access without notice for violations, fraud, or harmful conduct.

Upon termination, your right to use the services ceases immediately. User content will be deleted within 30 days, except where retention is required by law. Intellectual property rights, disclaimers, liability limitations, and dispute resolution provisions survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Albania. EU users retain mandatory consumer protection rights under their local laws.

Disputes are resolved through the following process:

• Informal negotiation between parties
• Mediation via an independent third-party mediator
• Binding arbitration (if agreed upon by both parties)
• Jurisdiction of Albanian courts as a final resort

All disputes must be resolved individually (class action waiver).

14. Miscellaneous

• Entire Agreement — These Terms, together with the Privacy Policy, constitute the entire agreement between you and Skyline DevHub
• Amendments — We may modify these Terms with notice; continued use constitutes acceptance
• Severability — If any provision is found invalid, the remaining provisions remain in effect
• Assignment — You may not assign these Terms; the Company may assign freely
• Waiver — Non-enforcement of any right does not constitute a waiver
• Force Majeure — The Company is not liable for failures due to unforeseeable circumstances beyond our control
